I do not get it.
As far as I know, a CP applicant can always switch over to AOS if already inside the US. It is harder for an AOS applicant to switch to CP.
You will have to make a choice. Do you want the benefits of CP or AOS? The way things are presently, you cannot have both. So pick one.
But the PD has to be current to switch over.

I think I have joined IV in last 3 years or so...
Donated money once & have called congressmen & senators many times ...
Could someone please tell me -
What has been achieved by IV till date? I know we all meet elected reps, officials in washington dc ..... but I am interested in end result like not wasting visa numbers , implementing spillover & along these lines.

What I am finding is, there are not enough people to do the really complicated stuff. Because of demand and supply the salaries are going up for folks that do specialized tech work( say OS Kernel development).
Then again, nothing in this world is too difficult, so lot of this stuff is getting pushed out to development teams outside of the US, where it's cheaper to get it done. The only downside is the ramp up time.
There is a critical point when it becomes too expensive to hire anyone in the US and the folks elsewhere are sufficiently ramped up, at that point we can thank all those who are against employment based immigration and find an alternate career :)
It is also obvious that the current graduates are more reluctant to take up jobs in US or stay here for a long time due to the following:
1. Messy GC process as more students are becoming aware of the situation
2. Ability to work freely in a competitive environment
3. Boom in their home country (India and China) [A survey shows that majority of foreign students are from these countries]
4. Ability to start at higher levels over there compared to start up jobs over here
5. Can stay with family
In our team, we are trying to hire 3 full time employees in west cost with specific skill set and could not succeed for the past 6 months :( One of my friend who is leading a team, recently want to expand his team had a similar issue. He finally setup an office in India and recruited people over there.
These trends clearly indicate that US is loosing clear competitive advantage and more jobs are moving off-shore.
If for some reason I move back to India, I am sure that I will be taking away as many as 10 jobs along with me as well :)

If your attorney filed your case, then:
EAD is sent directly you
FP is sent to you and your attorney
AP is sent to your attorney.....
All these are sent by USCIS via regular mail.....
Your attorney might have sent the AP documents to you via DHL...
No - It came to me directly from Texas Service Center. My Lawyer didn't even know - I informed them. All three EAD/AP/FP directly came to me except receipt notice which were sent to my Lawyer

Regardless of the incorrect forum to tell about yourself, your story has serious flaws.
you are just telling us your side of a photoshopped story.
Even after you are here illegally, you can correct things and take a legal turn. there are so many cases where people who have overstayed or crossed over illegally, got themselves deported and or brought themselves out of the closet and applied and got their citizenships.
Also, bcos you spent 30 years in the country, you should be given a priority over a kid from your country who kept applying for a green card lottery every year, trying to enter the US legally?
to make matters worse, you stayed illegally in a country and did not follow the rule of law.

2. I am no longer fighting for my rights. I�m OK. I�m in my own country with all rights available to me and am offered a Waiver by the U.S. to visit my friends, family and loved ones when I want. Today I�m fighting for my USC Immediate Relatives� rights from my country. How many of you high&mighty can say that? Probably never will too. You�d have to walk in my shoes and from my view none of you except for 24ps can fit them, though sledge_hammer might have to learn how to walk in them. Man, this place just needs a reason to go all-out hysterical. Seriously, what is the problem with this regulation? Employment verification is just the DMV's way of finding out if the person is in legal status. You had to show this letter when you got your visa stamped didn't you? Similarly, American citizens have to show proof of citizenship while applying for a driver's license. These are good law-enforcement measures the govt is taking to prevent out of status immigrants from getting a driver's license.

The same memo also talks about AC21 - to me, it sounds like those who qualify under AC21 can also get 7th year extension even though they are currently not on H1-B status. Could someone please clarify if I can now "recapture" my now-long-gone-H1B based on this memo and the following information?
- I had a H1B visa, whose 6 year period was going to expire in Dec 2005.
- In Oct 2005, I changed to a different employer using AC21 & EAD. So the H1B became void at that time.
Now, under the clarification by this memo, can I apply for the 7th year extension of my old H1B and switch back to that (rather than using EAD to work in US)?

All i can say for you is angoor khatte hain(grapes are sour for you) since you didnt get it.
This is what happens to jealous people.
Anyways, we have played by the rules.
What do you say about people getting GC by lottery.
Go and blame the govt for the rules not us.
I don't care about LS. Almost all cases I know are fraud. Sometimes 2 guys got GCs on same labor(since they were not asking Original LC). Thank god USCIS banned LS.

If we don't make it clear in our replies that we do not condone any actions that break the law, we are just making it easier for anti-immigration people to easily point fingers at us and claim we are all drug peddlers or criminal.

I am a physician myself who served j1 waiver and on AOS from 7/07. My son is a going to be a senior in High School this year. Why did you have a problem with state college apps on AOS/EAD?
Most of the state colleges, (In my case, none of the state colleges), including under-grad and medical schools, will accept application, if you do not have GC/ US citizenship. I tried, wrote letters, but of no use.
You can apply and get admission in private college, which of course cost much more.
Also, we were not able to take any federal loans.
