The only leeway USCIS has w.r.t EADs are the duration of the EADs and not the timing of the issue of the EAD. The fact that the EAD can be given only after the I485 is filed is governed by the INA.
Further the grant of EADs in all the eligible categories is more or less the same. Even if the timing of the grant of the EAD were in USCIS hands ,it is hard to request an alternative interpretation of the regulation in some cases (eg after I-140) while retaining the same interpretation for other categories (eg EAD after completion of Education). This just opens up a lot of loopholes.
ON top of all this we have to take into consideration the huge inherent inertia of the USCIS to change. As already pointed out the only recourse available would be to change the law of the land, on which path we are already traversing.

July 6th filer awaiting FP (no SR opened yet). My case has been transferred back and forth between Nebraska and California. I asked my lawyer - he advised me to "Sit tight as there is nothing that can be done except to wait for them to process my I140, I485, I765 and I131 applications."
So here I am, still being underpaid and abused by my current emloyer. ...waiting for the day that I can escape and get a better paying job and work in an employee-friendly environment.

+1 = Is this the commerce 1st year?
+3 sounds to be your diploma right? now what was eligiblity for the diploma 10th or 12th? I am assuming it was 10? since it was 3 years course.
My friend I hate to be sounding pessimistic but your education might add upto 16 years but it is not progressive 16 years as required for a bachelors program, most of it is redundant. your +2 (12th grade) and diploma are overlapping. Your +1 is completely tangential to your course work. It is same as some one doing 1st year courses for 3 different strems example 1st year Science , 1st year arts and 1st year commerce and then claiming he has equivalent of 3 years bachelors course work completed and so he be awarded a bachelors degree.
Please dont feel bad. I do not want to give you any false hopes. Please consult some proffessional evaluators to check if there is a way they can make your education sound progressive but looking at USCIS response you pasted they have evaluated your diploma and cannot accept it as equivalent to degree program. Or saying I have 2 Masters degree so count it as equivalent to a PhD that cannot happen even if the person might have completed equal number of credits as PhD still it is at masters level and not at PhD level plus they are not cumulative which will be the most sticking out point.
I dont know who will pay for the MTR + refiling in case your employer is going to shoulder these expenses then there is really no harm in trying but if it is you who has to pay for appeals then my friend it will be better if you consult education evaluators and some other lawyers like Murthy, Khanna to get a second opinion before you embark on this long and costly journey.

To mailmy_gc : You are very lucky to have it on the 100th day i guess..Mine is pending 98 days and i went to local office - Newark, NJ today and they told me your file is with the IO and you are probably struck in background check - cant understand he spend 90+ days on background check alone! and i am still counting. I met atleast 3 people whose EAD is pending and expired and are counting days. I cant beleive USCIS is no ruthless and care a damn about legal immigrants.
Can anyone tell me how else i can expediate? - I already tried 2 Info pass, one service request, Letter to CIS ombustman (they did respond with rrecommendation). I havent contacted senator (does it help - if so do i just call them or go to there office?). Any input will help.

The following was the message for the first one which was 2 years ago.

In the latest RFE, they didnt say anything about digital. Just wanted me to submit another set of pics.

Yes... benchmarking is good (in many things as you suggest quality, corruption, infrastructure etc.)... but absolutely not in everything as you suggest, some things just aren't comparable given some micro-economic conditions. Further, doing so would also encourage the mindset of aping the developed countries in every department. Remember the India that we see has gone through hundreds of social and economic cycles over thousands of years. It is not a nation that came to being a few hundred years ago and was a developed country (in current terms) many times in the past.
If one learns history then one also learns not to just take a slice of it for generalization! A holistic view of what happened in the past globally and our current state makes one realize the hidden riches and clear shortcomings in any nation. One need not level out it's hidden riches to clear the shortcomings !
Yes I agree, our history and way of working is also different maybe better/worse, but defenitely way more experience! I don't think I would want to change any thing about family , friend relations and the way we help each other. Even some of the ways we think, has a lot of advantages.

Man, I-485 for Texas went back more than a month. It's so bad, they might as well not have published it, one would have slept better at night.
How do they come up with these dates? Weren't they supposed to process I-485 applications in the order they received them?
And how come the California Service Center has been doing so well this past few months, while all the other centers have been stationary or going back. CSC is at January 2007 now, fer cryin' out loud!

Pune, India in 1996, i just filled out a form, attached a no objection certificate from my company and got a check in 2 weeks. I did not have to pay a dime, i wasnt asked any. I guess it was probably because i was in no rush to get the money.
I try not to pay out money in india, it takes time to get things done, but they do get done...maybe things have changed alot since, but i hope it should not be that bad.
I do not know in which city of India you took out your PPF.,
But I heard you have to pay atleast 5% to get PPF back in Hyd.,
Hope corruption will not be that high by next 20 years in India!!

I had real bad experience with digital pics. But there are many people who didnt have any issues. So it is all your luck.

You say all these because you understand. Most of these police officers out there (and even Immigration Enforcement officers) dont understand the laws they are enforcing. I once asked an american embassy consular officer during an H1B renewal interview how long I had to stay in the US if I get laid off from my job. She smiled and said she doesnt know. Ironic right? That is US Immigration laws for you. So complex yet so unreasonable.

Unfortunately IRS doesn't help.. And employer get benefit of doubt for lost mail :-) But they'll send you a form to fill and submit instead of W2... At least thats what I experienced... I also thought that employer cannot withold W2.. But yes, they can... due to lost mail concept :-) They'd send W2 copy to IRS without fail.. just the mail to employee would be lost...
That reason if not genuine would be a lie and its a crime especially when it comes to tax matters and uncle sam is involved. I was advised by a atorney to file a complaint and in my case the customer care at IRS contacted the company HR directly.
