The best thing DOL did was to get rid of Labor Subs. Period.
Why:
1. I've paid Social Security taxes + Medicare + Income taxes longer than people who've come here in 2006 and used LS. If I don't get GC (frustration due to retrogression), aren't these guys enjoying (or going to enjoy) benefits that I've paid for, for a longer time.
2. It's really no different than the system in India (or what used to be)for getting everything from telephone, passport etc. where a select few jump ahead in line by either knowing somebody or paying somebody. Isn't that one of the reasons a lot of us decided to move to the US for better(fairer?) opportunities.
3. Isn't this very similar to the falsifying of experience people do to get better positions in a company?
4. Yes, I do have a problem if after slogging my butt off to get a Ph.d, somebody with 3 yrs + 2yr of NIIT comes in through desi consultancy and gets far ahead in line than me. Now before somebody says NIW+ EB1, let me tell you that it's not that easy to get it in the Computer Sciences.
Anyway, having said that it's no time to be divided, but to present an unified front in getting legislation passed that eliminates exactly this kind of discussion. Atleast 20 yrs down the line when we talk about arranging marriages between our children, let how we got GC be a deciding factor in who's got the bigger status :D

since the new supplemental memo has been issued, the rule making agenda may be pushed off. but i think the new memo will be effective immediately.

Reading the bulletin thread and prediction thread is good enough to prepare for GMAT problem solving area. I love these analysis and conclusions.
I think that the DOS (Dept of State) releases VISA Numbers on a quarterly basis. If that is the case, there should be movement in EB2 India in Jan 2007.
The other possibility always exists that the numbers were released for this quarter but the demand was SO HIGH that the net date did not move at all.

No. I am not an employee of any of the companies named in H1B visa fraud last week. The current employer is my the sponserer of my H1 B visa and also my first employer . I did not change my employer.

I am of the opinion that issues such as 'allowing I-485 even if visa data not current' or 'allowing for application of EAD once I-140 approved' could be addressed by urging appropriate agencies to make changes to the existing regulations. As bharnik pointed out there is no effect on the visa numbers for the USCIS, by allowing this. While we fight and wait for legislation, this is a very good short-term relief.
Is it possible for IV to brain-storm on this? and come up with an approach to address this, without having to go through the congress?..

Allowing I-485 filing without visa numbers is not possible without changes in legislation -- that is why that provision had to be tacked on to S1932 and why it is included in the Brownback amendment. The same would be true for changing the CFR.

Meeting with Lauren Hole, Field Representative of Rep.George Miller (Concord).
A group from CALIFORNIA Met with Lauren. She was not aware of the EB based GC process. So we updated her on the process and the issues. She patiently listened to us for an hour. She said she would bring it up with her counterparts in Washington, but was not sure if she would be heard on this. When asked what we could do to make us heard, she said " Just continue what you are doing.. Contact your local Congress persons".
Meeting with Luis Quinonez and Pepei Yu, Field Reps at Rep. Barbara Lee ( Oakland).
This meeting went very well, because both of them knew very well what the issues are with the Labor BECs and with the Retrogression. They also knew about all the bills around the immigration. They had gone through the IV web site and also the brochure.
They were very sympathetic to our cause and said "Barbara Lee is on your side. And we understand all your problems and we are with you in asking for these reforms". They gave us some specific action plans:
Get a few people who live in Oakland to write to B.Lee's office stating that :
They live in such and such address (should be within the Oakland congressional district)
Their case details with case number.
That they represent Immigration Voice which has several x number of members who are similarly affected.
State our cause (goals) and request that Rep. Barbara Lee should please consider / vote favorable for our case.
Pepei Yu mentioned that if they get these letters, it gets filed and entered into a database and is seen by the Congresswoman. So, we have to draft the letter and get about 10 �20 people in the Oakland Congressional District to do this. Please get your contacts or friends to do this.
Pepei Yu also educated us that the Congressman / woman can only look into matters of their own Congressional District . It is considered federal felony if they engage in interests of other dicstricts. So she said it is very important that we get people to appeal to the Congress person of their own district. The Congress person they should contact is the one that governs the place where they live (not the place where they work). She suggested that we make a template of the letter and use it across the country replacing our names and the Congresspersons name as appropriate. Both Luis and Pepei stroingly encouraged us to do this across the country and mentioned that this was a sure way of reaching out and making our voice heard.
3. They were very helpful and suggested that we keep in contact with them to monitor these issues. They also offered to let us know when they may have someone from the USCIS or other such Immigration related authorities addressing open forums.
They strongly suggested that we get in touch with Senator Feinstein (they provided a contact) and also get in touch with every congress person in the area (Bay Area) � esp those that are Moderate Democrats. The thinking was that it may be easier to get the moderates over to our view point rather than people who are totally against immigration.

very well said goel.. I said the same thing to IV and I got God knows how many reds. The only time I saw a huge impact was after July fiasco but again it was not IV's alone effort, many other organizations were included.
Honestly IV is a great platform to help members with their questions and exchange knowledge about immigration topics but nothing more.. I don't expect the founders to leave their full time jobs to address immigration issues as without a job they won't have any immigration issues.
To people who say that illegals have huge support and resources that is because they have lobby money from businesses who need cheap labor, lawyers who need new clients and politicians who need (future) votes..
In our case business know that first we are not any cheap and second they can move the jobs overseas.. Lawyers already know that they have us by the b***s and politicians flip - flop depending on who they talk to (citizens or us).
I think I have joined IV in last 3 years or so...
Donated money once & have called congressmen & senators many times ...
Could someone please tell me -
What has been achieved by IV till date? I know we all meet elected reps, officials in washington dc ..... but I am interested in end result like not wasting visa numbers , implementing spillover & along these lines.
I have asked few friends to join IV but then if they ask me for IV accomplishments - i can't count any....

This is a "do nothing" congress. They dont care about immigration reforms as this doesnt have immediate affects. Frankly i have no hope. Nothing is going to happen till summer of next year.

2) Writing to Ombudsman.
Since no one in America does much of anything in December I am planning to start trying with congressmans office in mid Jan. I have to do something and try - I cant keep sitting hands folded. Or they will say quota is over before we know it - remember ROW is at 2005.
That's true that Dates becoming current does not necessarily ensure that someone will work on your case. Writing to Ombudsman might help (but not necessarily). There is a simple form, Form DHS-7001, fill it and send to Ombudsman (address to send to is on the form - you can search for the form). They forward it to your Service Center for an answer within 45 days. If your dates remain current for this 45 day period, there is a chance that your Service Center will look at your case. If not, Service Center may just wait until your dates are retrogressed again and send a standard reply that you are not current.
Taking an InfoPass might initiate some action too.

Does any body think of people who did not get a chance to file I-485 who had earlier priority date(2002-mar 2005) ?
Nag, you mentioned in one of the posts that your wife has a PhD in CSE. Why can't she join a university as a Post doctoral fellow (PDF)? I do not know what type of work authorization is required for that, but my guess is she can easily get it. She gets paid and will have a chance to apply under EB1 category which is almost always current. You can file as dependent. No point whining about folks discussing their EAD/AP issues. Everyone knows BEC guys got a short shrift in this.

Macaca, what a great idea! Can you or someone approximate the figure f how much we have cntributed to SS (and better yet, how much would stop going into SS if we all left in a reverse brain drain)

Look in your pay check and compare this amount with the amount you contribute to IV and the benefits from IV.
SS is a mess and so everyone loves the donations (not contributions).
Congress knows about it and may have a better # for it.

In order to approximate it we need the the number of H1B's and their average salary
