Just got the mail Card production ordered(myself, spouse , dependent).
Raised SR on 2nd May Got RFE on 3rd , received the RFE(Employement Verification) on 8th.
replied the RFE , USCIS received on 12th.

So are you saying that date will go back in the middle of the month?
I am saying that GC quota can get exhausted in July. It is possible that it gets exhausted early July since very few GCs would be needed in July.
I don't know if there is a law for retrogressing in the middle of a month. If there is no law, then there may be a USCIS procedure. USCIS has been informing when it sets up or breaks a procedure. It has not done it so far. There may be no legal consequence for breaking this procedure.
If there is nothing written (just good faith between lawyers and USCIS) then USCIS will do anything they feel like. They have been doing it for a long time.
Based on info posted in IV threads, it is not a rumour anymore. Else USCIS clarifiaction would have come out or will come out.

I would suggest our discussion with the congressional staff should focues on relief in two parts. Many in media are reporting that there is going to be another stimulus bill after healthcare reforms.
So we should try to get waiver on green card quota limits for buying a house. We can make it part of stimulus bill.
All other things including termination of country quota, racapture, exclusion of dependents can be part of CIR.

There is an advantage to filing through CP when USCIS is slow to process applications. According to statistics this has been the case for last 10 years with USCIS.
CP approvals are pretty fast and when you apply they do not wait till the dates to become current, NVC process the application to the point where the only thing it needs is a visa number.
For example April 1st when an applicants PD is current NVC will request a visa number for the applicant and any derivative applicants around the 10th of April (this is stadard practice). Then typically in the next 60 days (May or June in this case) schedule the interview. You get the visa after successful interview.
If you filed AOS, USCIS is supposed to pull your case and start working on it when PD become current. From what we hear they do not do this properly, they do not follow establised guildlines (FIFO). CP has a distinct advantage in this regard. Only thing is you do not get to have EAD/AP.

Years we have been told priority date establishes your place in the queue.
We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.
Aint fair. Aint fair at all. How can this be. How can rules be changed in the middle of the game.
Dont worry. If your LC still in BEC with old PD you are more luckier than the guys going to file 485 now. DOL commited to clear backlong by Sep 2007. Oct VB will come up with priority dates in stone age. If your PD is very old you will get GC with in 6 months. Filing 485 in July and Aug with very new PD will not bring them any fruit. They have to wait more years. 750K 485 and 750K EAD and 750K AP will result in choking the CIS system. They will feel the challange of renewal on time.
I am very conficent that USCIS is not going to process all 750K at a time. They will definitly modify the processing method, fom current practice. First, they can not schudle FP for all 750K applicants in available ASC centers. So, they will sort the 485 based on PD, and process tham based on PD and country and catagory wise. A guy with PD 2007, will not get FP notice very near to his PD become current.

Yours and illinois_alum were in the excel sheet and were current? Were there anyone else current in the sheet we sent to USCIS and waiting for EAD? We need to find out if they cleared the easy cases first and gave them GCs instead of processing EADs. As per our latest information, USCIS had been going through the scanned notices. The NSC issue fix was already set in motion last week. It remains to be seen how soon NSC EAD cases are cleared. It will not be overnight, and may take some time, but we have to monitor the improvements in NSC.
