I didn't miss a zero. USCIS gets 456,000 apps per year. They can give 521,000. Which means they have extra 65,000 per year. So to clear 600,000 at the rate of 65,000 per year is about 9.2 years.
This is not a discussion for this, but your argument is not clear. If USCIS gets 456,000 apps per year, and they can clear $521,000 per year (more than what they get), where is the question of 10 year wait? New applications don't get cleared first, they are put at the back (of course with a lot of inefficiency, and irregualrities). Wait is due to uneven distribution of apps/countries.

Mostly repeating
1) H1b extension and visa stamping by post (very very essential)
2) Reinstate premium processing for I-140 (very urgent)
2) Preventing wastage and recapture of visa numbers (atleast atempt)
3) I cannot buy a house because of uncertainity
4) WE TEND TO SAVE MORE AND SPEND LESS WHEN THIS UNCERTAINITY PREVAILS. and lot of us have tremendous spending capability (cars, houses, tourism etc)
5) Canada and Europe needs me and lot of US educated/skilled people, so please USE us BETTER.

macaca it does make sense. This si what they are doing...opening up the flood gates and allow for a flood. from this flood they will be able to easily approve 40k cases.
once that is done they will shut the flood gates so that the level starts moving towards equilibirium...with labor substitution ending on july 16th ...the 70k backlog elimination labor aps will be done quick enough.. since many will have redone their LC in PERM..and uscis will have an accurate headcount of people in line from this floodgate opening process.
i dont think we ll see retrogression back to 99... but maybe more mangeable levels

USCIS has to issue EAD within 90 days (and you are within the period) or else it has to issue an interim EAD, especially so that the applicant's job is not jeopardized.

The Ombudsman office's recommendations:
The USCIS Ombudsman made some recommendations regarding EAD processing:
 Adhere to regulations that state USCIS shall issue Employment Authorization Documents (EADs) within 90 days, or issue interim EADs, to prevent unnecessary loss of employment;
 Expeditiously provide information to the public stating the cause of EAD processing delays and how the delays will be addressed;
Ensure USCIS provide consistent guidance to the public regarding EADs pending more than 90 days via the National Customer Service Center (NCSC) toll-free number and local offices; and

Please excuse my ignorance but what is a "red-eye" ?
There is a flight leaving BWI airport by 9:15p - I guess that may be a good option?
What are the options to travel from BWI Airport to IV gathering point?
9:15pm is a good option. red-eye means late night flight. There are a number of options from BWI to downtown DC. A bus and light rail train will get you there in an hour.

It was merely an expression. I am sure you guys get the point.
Hangin there. 2004 will be cleared soon. If not this month, next month.
While the wait has been frustrating, the general wisdom hasn't been lost! Certainly GC isn't everything.
Anyways, thanks for the encouraging note.

The trend evey year is most approval coming from TSC not NSC. Why can't we suggest to close NSC so that all the approval could come from one place.

Friends,
I know once I 485 is filed and I 140 is approved after 6 months you can move to a simlar job.
My question is what you get laid off after 6 months of filing I 485 but you cant get a new job immediately, what if you get new job only after 2-3 months gap - what are the reprecussions ?
Also is there concrete guildlines on what same or similar job is ?
Thanks

Short term solution :
Understand and intrepret the correct spill over
Re-capture unused visas over the previous years
Now that we have the pending data from USCIS, we could create an persuasive and execellent presentation to show USCIS how EB3 I will never move even if more visas are re-captured, unless and until the spill over is used for EB3 I also

I think once couple of senators start rocking our issue others will start supporting too.
You are exactly right!!. It is the right time to send in letters (no emails or faxes) LETTERS to congressmen/women (just 2) for the state you live in. Also your house rep.
It is just 2 letters, guys, print them, put in a little envelope, stick a 41c stamp and mail it.

Going by that, I guess, dates may move forward very slowly until these new applications are dust-shed and taken for process. And, this may take atleast 6-9 months or more in my opinion (going by the processing times of various USCIS centers).
They have started FY 2008 with some caution after July fiasco and may ease it up a bit in the next couple of months. I am confident most 2002 cases and some 2003 cases would see approval in the next 3-4 months.
2003 EB3 India? That would be interesting (because dates need to jump forward two years for that to happen)

Hi everyone,
My friend is filing H1B visa from his employer which is a non profit organization. However since he is the only one that organization has ever filed H1B and according to him that his employer is only filing BCIS form I-129.
Dont the non-profit organizations have to follow the regular procedures? Of what I know these are the procedures for filing H1B.
1. Wage Verification
2. Filing Labor Certification Application (LCA)---Form ETA 9035
3. Approval of LCA----hard copy sent to the employer
4. Employer posts notices
5. Filing H1B visa petition, Form I-129
6. Waiting for approval.
His employer filing I-129 straight way, without following the other procedures, I was curious that things are done a little different for non-profit organizations- are they?
Is there a difference in procedure (except for the $ 1000 fee) of filing h1b between profit and non-profit organizations?
Any suggestion in this matter would be greatly appreciated.
Thank you

Hi,
I was wondering is this a firm news that- Labor gets expired after 6 months if you dont apply for 140..
It it right.. am thinking it depends on state to state ?
Appreciate your replies.
Thanks
Yes, approved LC expires after 6 months. This rule has already been implemented by DOL along with labor substitution elimination.

Actually today I received my CPO e-mail, so I will go down through my list! But anyway,
1. You can contact your local congressman and explain your situation
2. You can visit your local USCIS office through an Infopass appointment
3. You can file an ombudsman form (google it)
Good luck! Opening a SR was really helpful in my case.
Thanks for the info. Can you also tell us how to go through the other steps in your list?
Thanks once again. :)
