I agree with you that this isn't just fair to people who are stuck in DOL. People who have been waiting for years together will continue waiting while people who got their PERM approved as recently as this year will file for 485. Where is the justice in this? I guess DOS & USCIS have not clue what they are doing as far as the PD's are considered. Couple of months back they had retrogressed as far as 2001 (EB3) & 2003 (EB2) and now they have all become current. How can this possibly happen?
Few of my friends purchased pre-approved labors paying thousands of dollars (which I don't approve anyways) and now they feel cheated having wasted the money for nothing.
I am happy that at least the recent applicants do not have to go through the ordeal which most of the members of IV had to deal with for few years now. My sincere hope is that they value their GC as much as people who have been stuck in this backlogs. It would be a very ungrateful of them, if they think that getting GC's is a piece of cake and it can be obtained in a year. I hope & pray that PD remains current for few more months so that people stuck in DOL have an opportunity to file their 485's soon.

Has anyone started fundraising yet??. I did not. I need to work on recruiting 6 more people atleast into Team IV. We should have 50 people for the Cal. Event atleast. I need to work on the networking events as well
I have started my fundraising, but that is only because I have all the fundraising ideas in my head.
I will start sending out the Welcome Packages this week. The Welcome Package has a section for Fundraising and will help each Team IV Member reach his/her goal.
The first T Shirt order has also been placed, last week, I believe. I should be receiving this initial order by mail shortly and then I can mail out the T Shirts to those who have signed up thus far.
We need to still concentrate on our recruitment efforts this week and the next.

I've mailed my application on 3/16 and received by Houston office on 3/18 as per fedex tracking..
I sent an email to passportcgihouston@swbell.net on friday and got the response that my application was not registered in their system..
Is there some waiting time to register the application in the system?? I'll send another mail after 2 days..hopefully it will be registered by then..

I thought, 15000 members was a small goal. But I guess we have to start with even smaller goals. I agree with Amit.
There's too much at stake to give up this campaign. Without membership, we are a weak bunch. To fight organized campaigns by groups such as Numbersusa we need the member strength.
Let us aim for 8000 members by Jan 15th. Current membership stands at 7919. We need just 80 members to reach the 8000 mark. If 10% of the current membership brings ONE member by Jan 15th, we can easily reach that target. With 300000 immigrants in this kind of quagmire, cant we get 80 people? I believe we can.
Let's join hands one more time and try to Add just ONE member by Jan15th. It is for our own sakes we will be doing it, so let's do it!!!

Adding / filing for Spouse's 485 should not be dependent on one's priority being current. This in turn forces the primay applicant to remain on H1b status to maintain spouse's H4.
(Above applies to those folks who got married after their primary 485 was filed but expected to remain pending due to retrogression.)
I would think that the above ties into the fact that dependents are currently being counted for visa numbers.

My 485 petition is with NSC. I opened an SR last month and got a rather uninformative response today. It does not tell me if my petition has been pre-approved or has even cleared the background check.

I think last month they were not working on Feb 06 cases and probably they have assigned your case to a officer by now ...just pray and hope to see approval soon

Just got the mail Card production ordered(myself, spouse , dependent).
Raised SR on 2nd May Got RFE on 3rd , received the RFE(Employement Verification) on 8th.
replied the RFE , USCIS received on 12th.

I really like this idea. Core team should give this a serious thought. As macaca pointed out, it wouldn't make a difference to certain ppl, but should motivate quite a few others.
Is there any way to distinguish contributing members from non-contributing members when they post on forums ... something like adding a field to "Join date", etc. to show whether they are contributing. This will at least persuade some members to contribute out of shame...

I am in new job and mid of negotiating with blood sucker desi employer not to revoke i140. I can not attend the advocacy days.
Anyway like Eb3retro I also lost my interest so changed job. Profile don't meet much with what written in i140, so who cares if GC rejected I will be heading to India.

I would change my contribution to $50 monthly if we have 1000+ members to sign up for the monthly contribution. Meanwhile, I would cancel my contribution if this goal cannot be achieved by all our 8400 members within the next two months. I cannot see any point if most people who suffer from the possibility of waiting for years would not contribute while I, who might be one of the least painful ones, contribute.
No offense, but, I would continue or increase my contribution, not because someone else is doing so or not doing so, or not if I would I get a tax break or not, but just because of my sheer appreciation of the IV core group's amazing efforts.
I have not (in the recent past) seen such a group of dedicated, decent and diginified people working together in a selfless manner to achieve something not only for their own good but for the good of hundreds and thousands of their fellow "sometimes not so polite, not so patient" sufferers.
I see my contribution to IV something similar to a contribution to a church or a temple. You give, not so that you'll benefit out of it, but because at the end of the day it is money well spent for a good cause.
If you benefit out of the efforts possible by your contribution, that's a nice bonus.

I think most on here know that IV's central goal is to clear the backlog

This really captures a lot of what all the "desis" do. Eat a lot of food and watch movies.
Me and my friends joke about it all the time. We try very hard to break from it but its really hard.
On a serious note I agree one should live life to the fullest but I think there is a balance.
Money is not everything but one shouldn't go bankrupt or end up in foreclosure trying to live life to the fullest.
I know those desis who are super savers and will never improve life style and I know those who are always on the edge of bankruptcy because they wanted to live the american dream.
I believe there are always two camps in any group, different view points, ideas and observations.
I firmly believe even if words are harsh from some members they donot mean that bad, or they just simply cant see other's view point.
Over last few year, i have observed something and that bothers me, the point is
"We (Indians) are interesting people, we want to live as an indian in america";
save a lot of money, go home(india) for 15 days ....say bad things about india
and then come here...start saying bad things about america.
I like some points aobut half hearted work from some fellows. I totally agree.
Here is my simply take, if we want to live and compete hapilly, we have to really live in america as an american.
How can an indian who slept all afternoon on weekend, then watched a movie and ate heavy dinnner at night with 5 indian families who all taked about negative things in america; will /can compete with american on monday morning...when this american
got up early on saturday, ran 10 miles ...full of energy....took his/her kids for camping or went on its own, ran /exercised on sunday may be a long trek in woods...he is fresh, ready to work, creative...
I donot think anyone who slept all week/watched movie/talked negative about american society /about america can compete with someone who lived for full weekend.
These are just small observations.
In short, most of us are still living an indian life in america. This will not take us far,
If we want to be happy we got to live as an american in america.
Money is not everything,a big bankbalance will do no good to anyone at age of 65 when you cant move your leg let apart run or play.

Your lawyer is right I am not clear why but I work for a big company and even my lawyere told me that.
The labor is location specific. When you are working for a company and If you applied GC for the same job you are doing then there is no concept of Future employment. You are holding the job.
The only way as far as I understand is repllalying for Labor and 140 from current location and transferring your Priority Date.

My friend (in the US, on J1, no HRR) has been offered a position with a Non profit organization. They do not have experience with H1b process and want her to tell them about the process, and how she can work here legally (starting June).
I understand that she will not fall under the quota and does not have to wait till Oct 1st. Can someone please provide information (some links) on the following:
1) Can one do premium processing for H1b (first time for her), even though it is a non profit organization? Or is premium processing only for cases that fall under the cap?
2) I noticed that the fee is:
- 190 for application
- 500 for fraud security
- 750 or 1500 depending on whether there are 25 or more employees
- $1000 premium processsing
- $$$ for the lawyer to prepare and file the petition
Is it required by law that all the application fees be paid by the Employer, or can it also be paid by the beneficiary? I understand that the permium processing fee can be paid by the beneficiary, and perhaps the lawyer fees too.
3) Does the employer need to get any certifications/approvals from the Labor department before filing for H1B?
4) Can the entire process by done online?
