It seems some people already coverted\or in the process of coverting from Eb3 to Eb2. Even I did that recently.

This process was already done by many in later part of 2005, entire 2006 and in early part of 2007. We do not know how many got out from the 485 Que in 2007. Many of those might have filed 485 recently in the july fiasco. The impact of these conversion will be felt only after 5 to 6 months or even after an year.

The best thing to do right now: At the cost of repeating myself, bear with me.
I believe this is going to work: Write letters and post them to your senators. Senate is in session, and all its going to take is a little spark.
In the past, we have sent emails and webfaxes to senators only to get canned- pre typed responses.
Recently, I have realised that senators favour written letters, posted (with postage stamp) especially if it comes from constituents from their state. Same with house reps. I have talked to my senator's staff and they have advised me to write a letter.
The staff member said, letters are always read, and responded. Senator will send an inquiry to the appropriate agency. This will create an impact, all of us should write letters.

Congresswoman Zoe Lofgren (D-CA), chair of the House Immigration Subcommittee, sent Secretary Chertoff a list of questions and a request for documents from USCIS to get to the bottom of the whole Visa Bulletin fiasco. The letter is very interesting not just because it puts a heck of a lot of pressure on DHS right now, but also because Lofgren's folks imply from the questions that USCIS was short circuiting established security clearance procedures to "pre-request" visa numbers from DOS. If it turns out full security clearances were not carried out, USCIS will either need to say that they had the legal justification (which would be a public relations disaster for the agency) or that they intended to complete the checks after the fact (which would be a direct violation of their own regulations). The only way to avoid answering the questions and to make this go away would be to eat crow and start working the case July cases.

As some of you know, I have been working with news media, government leaders, and immigration lawyers over the past year because of the stimulus debacle. As a result, I have developed some strong contacts in government. I will be meeting some congressional immigration staffers in the next few days and I have developed a list of issues to discuss. If you want to post your own issues, feel free to do so in this thread and I will add them to the list. These are the same people who helped get the last stimulus bill changed in our favor, so they do have influence.
PLEASE be brief - bullet points would be good.
Also links to articles to support your concerns are welcome. I will put together a package to hand out at the meeting.

sorry to sound like a beaten record - but it seems that everyone here pretty much sees citizenship as fait accompli!
how has our respective motherlands harmed us that despite being pushed around by US for years on end -we are desperately seeking US citizenship?? after all - in many cases - its the basic and advanced education received at our respective countries that has made us qualify as "highly skilled" immigrants here.....

here is the first line of US citizenship oath - "I hereby declare, on oath, that I absolutely and entirely renounce and abjure all allegiance and fidelity to any foreign prince, potentate, state, or sovereignty of whom or which I have heretofore been a subject or citizen" - while i can absolutely live in US as a law-abiding, tax-paying resident - how can i renounce my country of birth?
I respect your thoughts and to some extent I personally share them. The primary benefit of citizenship for me and I believe for many others posting on this thread would be to bring our aging parents to this country and to be able to live with them.

For a full participation, I would recommend a red-eye on Tuesday or at least a flight after 9pm est.
Tuesday evening would be a Congressional Reception. After that we would have an IV meeting with members to discuss IV next steps etc. So keep departure flights to be late Tuesday night or after. I would highly recommend being in the Congressional Reception. You will get to meet several staffers and lawmakers here and talk to them.

We need a new bill which supports legal
Instead of starting afresh with a new bill, it would be wise if our lobbying efforts for legal immigration adjust to the changing political winds in Washington.
How Would a Republican Congress Handle Immigration? � The Washington Independent (http://washingtonindependent.com/101609/how-would-a-republican-congress-handle-immigration)
1. Based on the report above, the new heads of judiciary committee and Immigration Sub Committee are individuals who view "border security" as the first step towards Immigration Reform. Since a majority of members on this forum are LEGAL immigrants, we need not worry about any steps taken towards border security and ICE Enforcement.
2. We could take our efforts, straight to Congressmen Smith and King and explain the challenges we face in getting LPR status.
3. Congressman Smit represents 21st Congressional District (San Antonio- Austin) area, which has a sizeable Indian population. We can approach him after the elections and discuss our issues with him. I am not aware of Rep. Kings constituency in Iowa, but he can be approached as well.
4. Having a powerful "ear" to listen to our issues and given the limited controversy (Since a majority of US, are on the oft targeted H1B) associated with our immigration needs, we might ask the Congressman himself, what the right steps should be. (New Bill or take up the visa recapture bill (introduced by Rep. Zoe Lofgren).
5. Immigration Voice works with Patton Boggs to voice our concerns with the lawmakers. Former Senator/Congressman Trent Lott works with Patton Boggs. He was the house majority leader, Republican whip and is someone who has (or had) a lot of clout within the Republican party. He was a colleague of Rep. Lamar Smith. I am the Susan from www.expatsvoice.org and just so you know my husband passed away last year
He was the petitioner for my son who was to follow to join. We only heard son had aged out in Oct 2005 and was getting a court case ready in early 2006.
Sadly my husband became unwell in March 06, diagnosed terminal on 4th May and died 13th May 2006
Someone posted, there maybe only a few cases but the cost is huge from an emotional standpoint
If I win my court case this may result in others having benefit who were previously denied lets hope so and stand together on this.
The grief and deprression I have suffered is unbearable due to errors, delays and husbands death
The memo in cspa clearly says that the CSPA should be interpred expansively, to me that means common sense and compassion.
Until we get an amendment to CSPA I feel there will be so many more cases of hardship and termoil to come to notice

nope, EB3 is a different story altogether: there is always a big demand for EB3. People graduate from colleges in India and come here on H1s, many of them dont have either a masters degree or 5 years of experience, so have no choice but to file in EB3. Many big companies take a conservative approach with the position that has been advertised, and if it is a "junior" level position insist on EB3 (even if the person filing was eligible for EB2). Strictly speaking thats correct, as its the position that determines EB level, not just the person.
Its people with US Masters, or who have done their BS <2002 who have a shot at EB2. That data was specifically for EB2 India PD distribution. That does not mean the EB3 India line is smaller or will move any faster. There are enough people in EB2 pipeline to keep USCIS busy and that category retrogressed (with current quotas)

Both Addresses will be printed on the passport. One for current address in USA and other for Indian Permanent address.
Application form is asking for address to be printed and other address. I am planning to keep my India address (my place) on my passport. I use my passport as a address proof in Inida. It means i need to fill it in address to be printed coulum.

I am having hard time procuring a Non-availability of Birth record certificate(NAC) from my home city of Delhi. Is there a way around this? I do have affidavits from my parents.
This NAC is holding up my application. Can we submit the document that you get in 10th grade with date of birth instead of the NAC. The NAC process takes a month or so, Police check...local magistrate orders the local municipal corporation et al.
Any suggestion will be greatly appreciates. Sorry if this post is in the wrong thread.
Get a new BC made, and attach 2 affidatvits. I was able to get the new BC in 2 days. Though 'coz I was bon in a Hospital in Delhi, they could locate my records and the new BC specifies that Date registered was 28 years ago. It costed my parents about Rs2000, they got hold of a dalal in from of the NDMC office and he was able to get everything done. According to them there are tons of people standing there getting these things done.

Here is what the attorney firm (one of the top ones in the nation) used by my company sent. They are trying to file all applications by July 1st week.
The fact that they are not dismissing this as a rumour means that they accept there is a "chance" however small that may be that the USCIS can stop accepting applications and they can do nothing about it at that point.
Yes in a way they are cushioning themselves, by sending out these client alerts, so that they are not held at fault if this may happen. But if there was absolutely no chance for this to happen they would certainly have dismissed it outright as a rumour.

USCIS took this step evidently after receiving notice from the State Department, outside the visa bulletin process, that the available numbers had been exhausted. There are strong legal reasons supporting the argument that this action by USCIS was improper. Nevertheless, the fear is that USCIS will take a similar step with respect to all or some employment-based adjustment of status filings made during July.
The widespread belief among immigration experts is that, even if USCIS accepts all employment-based adjustment of status cases sent for filing in July, there will quickly be another rapid retrogression of immigrant visa availability. This would result in potentially many thousands of newly-filed adjustment cases remaining at USCIS for quite some time while applicants wait for the immigrant visa numbers to again become current.
Obviously, a decision by USCIS not to accept adjustment of status applications for some or all employment-based categories during all or part of July would be a devastating development for companies and foreign national employees who have relied on the July Visa Bulletin and are preparing to file adjustments. Many organizations, including ***** and the Global Personnel Alliance, are working to determine the true position of USCIS and the Department of State on this issue and to advocate for USCIS to accept all adjustments filed during the entire month of July in accordance with the July Visa Bulletin. We will send an update when definitive information is available.

I have read here or somewhere that there are only 150 to 300 GCs per month for Eb3 india If it is true then it will take more than a couple of years to get to you as there are 8000+ candidates before you.

H1B was not started to help people from all over world, It was started to help US corporates to fight talent crunch..
If someone is responsible for the current state of affairs in the H1B area , It is Indian firms . The H1B1 was started in 'GOOD FAITH ' by United States to help people from "all over the world" to come in and work in the US , but large Indian IT houses have overexploited these loopholes so much that we are currently in this sorry state of affairs . In their greed for higher and higher profits(every Indian firm hits 30% profits every quarter ) they have spoiled a perfectly working program a few years ago to such a state that now getting an H1B has got less nothing to do with talent but has become like buying a supperlotto ticket .Below is a very good article from the "Economic Policy Institute " that highlights the fact that 2 well known Indian firms have single handedly lapped up 65% of H1B visas last year and have applied for just 69 green cards . Thats a GC application rate of 0.0004%. i Cannot help agree with the facts in this article. If someone is responsible for the current state of affairs in the H1B area , It is Indian firms . The H1B1 was started in 'GOOD FAITH ' by United States to help people from "all over the world" to come in and work in the US , but large Indian IT houses have overexploited these loopholes so much that we are currently in this sorry state of affairs . In their greed for higher and higher profits(every Indian firm hits 30% profits every quarter ) they have spoiled a perfectly working program a few years ago to such a state that now getting an H1B has got less nothing to do with talent but has become like buying a supperlotto ticket .Below is a very good article from the "Economic Policy Institute " that highlights the fact that 2 well known Indian firms have single handedly lapped up 65% of H1B visas last year and have applied for just 69 green cards . Thats a GC application rate of 0.0004%. i Cannot help agree with the facts in this article.
