I submitted my application in-person end of last month and collected my new passport exactly a week later. Add 2 more weeks for mail transactions. Houston CGI is getting efficient.

Speaking for myself, I'm not seeing the value.

I see IV right now going off and tilting at windmills that will have little effect. Stuff like the I-485 without current PD for example, will serve to both alleviate the immediate issue of backlog, and make those responsible less likely to actually fix the problem, all while creating a permanent under-class of immigrants who will spend decades waiting for their permanent status.

So...when I see them advocating for things that will make a difference, I might consider contributing at that time.

    Guys,
Atleast now start thinking about Citizenship. For getting the GC, there are lot of hurdles. Most of us are living in this country for more than a decade and still our status is "Alien". We are legally here paying lot of Tax, Social Security , Medicare Tax etc.,
Please go through my thread on Citizenship and start working on that. Instead of wasting our time on GC, let us make an important Agenda and express our views on the path to Citizenship, so that Congress will think about it.

I do not have a GC which means my entry in US is not guaranteed the next time I visit my home country. Period. The risk is simply not worth taking. Congrats to those for whom it worked out. You are far and few people.

I recently had the taste of this experience when my wife got 221(g) at Mumbai Consulate and had to enter using AP. Imagine if she did not have an AP and if we had a home what would we do?

Today in this scenario we can atleast sell everything we have and cash out of US. The stakes and dependency gets higher if we own a house. I would advise anyone against "investing" money in US when you dont have a GC.

I bought a property in India in the meantime and the value has doubled and I am pretty happy about it.

    dudes,

I have requested to post your PERM details for the filed of work, TWICE now. Except for one, nobody responded. You guys are not telling about your filed of work. Looks like those who are in PERM trouble are from IT related filed ?

I am trying to see what prompts these audits. EB2 or EB3 or It or combination of EB2/EB3 and IT or non IT.

    Thanks,

i met a guy like this last weekend. came to US 2/3 yrs back. has masters in India and has 5 yrs total experience. not doing any research. He is actually a contractor at a client. the employer, applied his GC under EB1. he got GC under 1yr. I was amazed.
he says, his employer applied for few of his other colleagues too, but rejected. most amazingly, for one of his boss (1 or 2 levels above him) also they applied under EB1 but his app was rejected. unbelievable stuff. i guess the EB1 verification is random.

EB1 spillover may never come for some time in the future. The Indian IT companies are applying under EB1 for their PMs and Senior PMs (req: BS in any discipline + 6-7 yrs exp), labeling them as multi-national executives. They are also making the employee pay for the 140 and 485 so that the financial impact is reduced a lot by a potential rejection of the 140.

This is as much BS as labor sub. I think everybody here knows how tough it is to get EB1 classification for researchers. But what scrutiny is there for these "multi-national executives" ? All they have to do is spend some time in India or any other country as a PM or SPM, come to the US on H1B and promptly apply under EB1.

Definitely agree with herd mentality and haste, but can't blame them also. What if the dates go back again next month. So its a catch-22.

    good luck to everyone.

What i am trying to say here is firstly reaching congressman should not be on the first day itself which some of the folks are doing, atleast wait for a a couple of weeks. and then regarding opening SR i would say atleast wait for around a week or 10 days at the minimum if you are scared of dates moving back. And yes i am not pointing fingers at any individual so don't take it personally "gc_on_demand"

We e-filed for mine and my wife's EAD on April 30th 2008.

On June 19th I got this from CRIS

    Receipt Number: XXX

Application Type: I765 , APPLICATION FOR EMPLOYMENT AUTHORIZATION

    Current Status: Card production ordered.

On June 18, 2008, we ordered production of your new card. Please allow 30 days for your card to be mailed to you.

Then I got this one today.

    Receipt Number: XXX

Application Type: I765 , APPLICATION FOR EMPLOYMENT AUTHORIZATION

    Current Status: Card production ordered.

On July 29, 2008, we ordered production of your new card. Please allow 30 days for your card to be mailed to you.

I don't understand what games they are playing. I called them and they say now it was a hurricane issue. Texas was not working for few days. I told him I didn't see any such message at USCIS website though. Its been more than 90 days and finally I am planning to take a infopass appointment.

    PD: Oct 06.
    I485: July 07 filer.

This is actually a very good idea. Maybe not 10% even 25% is fine.
This way microsoft, oracle etc. can get their workers.
Even Deloitte, PWC they hire americans and pay you when you're on bench.
Unlike most indian consulting companies, which don't pay you when you're on bench and make you lie on your resume.

Why to you want to discriminate between one set of companies from another set of companies? In effect, discriminate between employees of one set of companies with the employee of other set of companies? Let me guess, you do not work for one set of companies but may possible work for another set of companies, right? I see some posts on the forum want to change the system as to best suitable their individual situation and they don't care if rest of the world is screwed.

With the green card backlogs, a lot of companies have many employees on H-1B status, waiting for their green card. As such the ratio of people on H1 to green card is increasing. Why do you want to punish the employee on H1, waiting for the green card for many years, because of retrogression? I am not able to understand the objective and rationale of your suggestion?

This bill is not just about limiting the % of employees on H1. It also says that employers will be "investigated" and "audited". "Investigation" is done when there is an allegation of a wrong-doing. So in essence, the bill says that as soon as you employ someone on H1, you have done something wrong. Even after listing the job on DOL website for 30 days and going through all the other stringent requirements, is that how it should be? When an employer hire an employee on H1, the employer is paying filing fee, lawyer’s fee and 8-10% taxes for hiring each employee. This "Investigation" and other stringent provisions to make it impractical to file H1 is simply to destroy H1 program. For now you may see the bill as to how it best suits your individual situation and then you may suggest how it further fit exactly into your situation before coming with an idea, like the one you suggested, but the bottom line is, this bill makes entire H1 program "non-workable" as mentioned by the administrator. And it applies to Oracle & IBM Consulting, PWC, Deloitte and every other employer.

My labor certification (Traditional EB-3) is stuck in BEC since last 5 years. It is completely beyond my understanding why it took so long for BEC to process my case. Now everyone is rejoicing USCIS's decision to accept all green card applications, but I am paralyzed with the fear of facing another huge backlog on I-485 applications. One government agency sits on our applications for years and another government agency throws us further back in the line to cover up its blunders and guess what who pays the price: WE RULE-ABIDING, LINE-WAITING FOLKS.

Even if I get my labor approval before September, I will be among the last persons to get labor certification in spite of being the one with the earliest priority date. Nothing would give me greater pleasure than suing DOL BEC at this time. We may not sue DOL on their inability to clear the backlogs, but we can definitely sue them in their utter disregard to FIFO procedures (mind that some people with priority dates in 2004, 2005 have already got their labor certifications, but some with priority dates in 2001, 2002 are still stuck). When I read on their web site that they have tried to maintain FIFO, it makes me feel like puking.

I am also disappointed with IV's attitude towards the backlog victims. I do not remember anything concrete done by IV to address the grievances of backlog victims. Now that they have won the battle with USCIS, will they have time to look at us?

    Friend,

We all pray for you to get out of this backlog soon.
While I understand your situation, I have a few words for you to think about.
If your PD is 5-6 years old (2001-2002), rest assured that you will be able to file your I-485 very soon after you get your LC.

Please try to understand how the system works. NO ONE with a PD of 2005, 2006, 2007 who will apply in july is going to get a GC before people like you!

PDs can not remain 'U' forever. They will definitely have to put in some cutoff date in October bulletin as new numbers for the next year become available.
If they make it U in the start of the year, USCIS will not be able to approve any cases and use the visa numbers.

The cutoff date that DOS sets is the PD of the FIRST pending application that can not be approved due to non-availability of a visa number.

So if they want to approve ANY application whose PD is later than yours, they will have to move the PDs atleast to that date. In that case, you my friend, will be able to file your I-485.

And mark my word, YOU WILL GET A GC YEARS BEFORE ANY ONE WITH A PD OF 2006 2007. (some exceptions are always there)

so i am curious why did you wait that long knowing that EB3 train is a goods train w/o engine. You r pretty close now to your GC, however if 3 yrs back or so you had ported it to EB2, you wud had been greened way back.

At that time, I was working for a multi billion dollar company where over a million people are employed. The HR department was not ready to serve any individual cases. Moreover the job prospectus were not great there at that time. It was always on the limbo. In fact, I did process another EB2 case in 2006. I got the I-140 Approval on that after the first one. And my employer's Immigration Department did not agree for a switch even after I pleaded to them. It was really hard luck. I spent over 18000.00 dollars to get that EB2 one which went down the drain. What to do? Its just fate.

No one knows dick about PD movement. EB3 filers think that somehow EB2 PD gets stuck or even retrogress and EB3 PDs race forward to 2003/2004, through some delusional logic. Those who filed under EB2 think, EB2 PD moves to 2005/2006. These predictions are mostly prejudicial. USCIS may have some idea after entering all June/July/Aug applications, that is if they can find someone who can add :D.

    My two cents...

And what about me? I have two files. One in EB3 -2003 and One in EB2 -2006 and both are live. :)

Drop the country limits atleast for some time (I think between 1998 - 2002 there were 190,000 H1's Allowed but there was not increase in the number of green cards issued it still stayed at 140 k anually) . Because there was need of immigrant work force in this country the H1 b # were raised. The immigration system is like a Pipe both the inlet and the outlet have to have the same diameter otherwise the pipe can be clogged(back logged). So during the 1998 -2002 the inlet was made broader but nothing was done to the outlet so now we have the clog.

Recapture the unsued Visas lost due to the adminstrative proccessing delays like name check, back ground check etc. For these visa numbers there were actaully people waiting for in the line but got pushed back due to adminstartive proccessing delays , but now all the paper work is ready after all the adminstrative processes but the visa #s are lost due to the policy of not carrying it over.

The other incentive may be green card for people buying a home ( Most people in the EB community have stable jobs and good income and clean back grounds).

Implementing these can help the economy and the housing market How?
More greencards -> More people from the Legal immigrant community start their own and implement their own ideas which have been bubbling in their heads for years . This could create more jobs.

More greencards -> More people from the legal immigrant community buy their own home which will drive up the demand in the housing market, which inturn will help stabilize the home prices.

These are some of my thoughts.
